Terms and conditions
These Terms apply collectively to all mobile products and services offered by the World Mobile Group of companies, including World Mobile Group Ltd, World Mobile Networks LLC, and World Mobile Treasury Services Ltd. Please note that while these Terms govern the overall use of our services, specific services may be provided by different entities within the World Mobile Group, and by using such services, you agree to be bound by the terms applicable to the respective providing entity.
These General Terms and Conditions ("General Terms & Conditions"), the Staking Terms and the Cellular Terms govern the use of mobile products, services, and related offerings provided by World Mobile Group Limited ("World Mobile," "we," "us," or "our"). The General Terms & Conditions, the Staking Terms, the Cellular Terms and the Home Field Advantage Offering Terms are collectively referred to as the “Terms”. By subscribing to, purchasing, or using our services, you (the "customer," "you," or "your") agree to these Terms, as well as any other applicable policies, terms, and conditions referenced herein.

- "Services": The mobile network services provided by World Mobile, including but not limited to voice calls, text messaging, data services, and other telecommunication services, as well as additional products, such as mobile apps, tools, and network devices.
- "Network": The infrastructure that supports the World Mobile Services, including mobile towers, base stations, decentralized blockchain nodes, and satellite systems.
- "User Account": An account created by you for accessing and using World Mobile’s Services. It stores your personal information, usage details, billing preferences, and network access details.
- "Tokens": Digital tokens used within the World Mobile ecosystem. Tokens can serve various purposes, including payment for services, staking for network participation, or being earned as rewards for contributing to network infrastructure.
- "Smart Devices": Devices that can be used to access World Mobile’s Services, such as smartphones, tablets, IoT devices, and other compatible hardware.
- "Home Field Advantage Offering": A special discount program offering a perpetual 30% discount on the Essential Plan and Advanced Plan subscriptions for qualifying customers who meet specific geographic and device requirements.

By accessing or using our Services, you acknowledge and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Acceptable Use Policy. If you do not agree to these terms, you must refrain from using our Services, and you are entitled to request account termination as outlined below. Your continued use of the Services signifies your acceptance of any modifications or updates to these Terms.

- Provision of Services: World Mobile offers a wide range of mobile services, including voice communication, data transfer, text messaging, and mobile apps, supported by both traditional telecommunications infrastructure and a decentralized blockchain network. We aim to provide innovative and inclusive mobile solutions to customers around the world.
- Decentralized Network: Our network combines traditional infrastructure with a decentralized system powered by blockchain technology. This means that part of the network infrastructure is managed by independent operators (node providers), who are incentivized with tokens for their contribution to the network’s coverage, performance, and security.
- Service Availability: World Mobile strives to provide seamless network access, but actual coverage, speed, service area and quality of service may vary depending on such factors as signal strength, network capacity and congestion, hardware and software limitations, terrain, weather, and other factors beyond our control. Outages and interruptions in the Services may occur and the quality and speed of the Services may vary. We do not warrant or guarantee that the Services will be available at any specific time or geographic location or that the Services will be provided without interruption or at any particular quality level. You agree to not hold us liable for any problems related to Services availability or quality, including, without limitation, any failure of emergency calls.
- Eligibility: To use World Mobile’s Services, you must be at least 18 years old or the age of majority in your jurisdiction. You must also reside in an area where our services are available. World Mobile reserves the right to refuse service to anyone based on our eligibility criteria or any other legal considerations.
- Lost or Stolen Devices: You agree to notify us immediately if your device is lost or stolen by contacting Customer Support via [support.worldmobile.io]. We will suspend your Services after you contact us during normal business hours or at the start of the next business day if you notify us after hours, to prevent someone else from using it. We reserve the right to hold you responsible for all usage charges, taxes, and fees incurred by your device until you have notified us that the device had been lost or stolen and until we terminated your Services.
- Home Field Advantage Offering: Qualifying customers may subscribe to the Home Field Advantage Offering, which provides a perpetual 30% discount on the Essential Plan and Advanced Plan subscriptions, subject to specific eligibility and device requirements outlined in Section 22.
California Customers Only: Although you are not liable for charges you did not authorize, World Mobile considers the fact that a call was placed from your device as evidence that the call was authorized. Unauthorized charges may include calls made to or from your device after it was lost or stolen. If you do not report the loss or theft promptly, you may be responsible for any fees or charges for the Service used until the incident is reported. Once reported to World Mobile that your device is lost or stolen and the device is suspended, you will not be responsible for subsequent charges incurred by that device.

- Registration and Account Information: To access our Services, you must create a User Account. During the registration process, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account details, including your username, password, and any other information required for access to the Services.
- Account Security: You are responsible for all activities that occur under your account. We strongly recommend enabling two-factor authentication (2FA) for enhanced account security. In case of unauthorized access, you must notify us immediately.
- Account Suspension and Termination: World Mobile reserves the right to suspend or terminate your User Account if we believe you have violated these Terms, or if we suspect fraudulent or unauthorized activity. You may terminate your account by following the process outlined in the "Termination" section.
[fs-toc-omit]5. Pricing, Billing, and Payments
- Subscription Plans: World Mobile offers various subscription plans for the use of mobile services, which may be based on data, text, and call volume, or offer unlimited access to certain services. Prices are subject to change, and you will be notified of any such changes in advance. Payments are typically billed on a monthly, quarterly, or annual basis, depending on your selected plan.
- Token Usage: Some services may be accessed using World Mobile Tokens, which are digital tokens issued by World Mobile or its partners. Tokens can be earned, purchased, or staked for network rewards. The value of tokens may fluctuate, and transactions involving tokens are subject to the terms of applicable platforms or exchanges.
- Payment Methods: We accept a variety of payment methods for purchasing services, including traditional forms of payment (e.g., credit cards, debit cards) and digital currencies or tokens, where applicable. You agree to pay all charges and fees associated with your chosen payment method, including applicable taxes, unless otherwise stated.
- Payment Disputes: If you dispute any charges, you must contact us within thirty (30) days from the date the charge appears on your billing statement. Failure to do so will result in a waiver of your right to dispute the charge.
- Legacy Plans: Customers on discontinued travel sim plans may continue using their existing plan until they switch to a new one. Legacy plans may not be available for reactivation.
- Home Field Advantage Discounts: Customers enrolled in the Home Field Advantage Offering will receive a 30% discount on the Essential Plan and Advanced Plan subscriptions, subject to the terms outlined in Section 22.

In the event of a breach caused by World Mobile, customers may be covered by Cyber & SIM Swap Protection.
Cyber protection applies to all plans and the amount covered depends on which plan and includes:
- Identity theft protection
- SIM swap prevention measures
- Fraud reimbursement
- Secure network protocols
To activate and maintain eligibility for Cyber Insurance and SIM Swap Protection, customers must complete the Know Your Customer (KYC) identity verification process at the time of subscription purchase.
This requirement is in place to allow World Mobile to:
• Verify the identity of the subscription holder
• Authenticate and process any future claims
• Prevent misuse of protection benefits
Important Notes:
• Cyber Protection benefits are only available to users with a verified KYC profile.
Claims made without a completed and verified KYC process will not be eligible for reimbursement or protection.
• Coverage limits and features may vary based on the specific plan selected and local regulatory frameworks.
• By opting into a qualifying plan and completing KYC, users consent to the processing of personal data in accordance with applicable U.S. privacy laws (e.g., CCPA) and EU General Data Protection Regulation (GDPR).
World Mobile reserves the right to amend or update eligibility criteria, coverage limits, or verification processes in accordance with applicable laws and operational requirements.

World Mobile offers multi sim bundle discounts based on the main plan selected. Discounts apply to a set number of additional lines with a fixed dollar amount off per person. This allows organizations and families to save while staying connected under one account.

[fs-toc-omit]9. Decentralized Network Participation & Token Rewards
- Network Participation: As part of World Mobile’s decentralized network, you may be eligible to participate as a node operator or in other roles that support the network. Participation may involve providing network coverage by hosting, operating, buying equipment, relaying data, or facilitating blockchain operations.
- Rewards and Incentives: Participants in the decentralized network may earn tokens as rewards for contributing to the performance and coverage of the network. These rewards are subject to certain performance criteria, and we reserve the right to adjust reward structures as necessary for network optimization or regulatory compliance. Please refer to the specific Terms and Conditions for the Staking Smart Contract for further details.
- Tokens and Exchanges: Tokens earned through participation in the network may be used for paying for services, staked for additional rewards, or traded on approved exchanges. You are responsible for any legal, tax, or financial obligations related to the transfer or sale of tokens.

- Prohibited Activities: You agree not to engage in any activities that are harmful, fraudulent, illegal, or otherwise prohibited by these Terms or applicable law. This includes, but is not limited to, distributing viruses or malware, attempting to gain unauthorized access to the network, or conducting any activity that would disrupt the normal functioning of the Services. Users must secure their devices against unauthorized access. Any breaches detected may result in service suspension.
- Acceptable Use Policy: You agree to use the Services only for lawful, personal, and authorized purposes. You must not engage in behaviour that violates the rights of others, including intellectual property rights or privacy rights. Any activity that negatively impacts the security, integrity, or reputation of the World Mobile Network or Services is prohibited. Unlimited data plans may be subject to throttling after excessive use.

- Data Collection and Use: We collect personal and usage data in accordance with our Privacy Policy. By using the Services, you consent to the collection, processing, and storage of your data as described in the Privacy Policy. This includes data related to your User Account, Service usage, network interactions, and transactions involving tokens.
- Blockchain and Public Data: Participation in the decentralized network may result in certain data being recorded on a public blockchain. This data may be accessible to other participants or third parties, depending on the nature of the blockchain network. You are responsible for understanding the privacy implications of engaging in blockchain-based activities.

- Ownership: World Mobile owns all intellectual property rights, titles, and interests related to the Services, including its software, trademarks, logos, and technology. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
- Restrictions: You are prohibited from copying, modifying, distributing, or creating derivative works from World Mobile’s intellectual property without explicit permission. All rights not granted to you under these Terms are reserved by World Mobile.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WORLD MOBILE AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND AGENTS (COLLECTIVELY, "WORLD MOBILE PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES (WHETHER INCURRED DIRECTLY OR INDIRECTLY), OR LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY USING THE SERVICES; (C) ANY FAILURE TO MAINTAIN THE INTEGRITY OF YOUR USER ACCOUNT; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (E) ANY OTHER MATTER RELATING TO THE SERVICES.
FURTHER, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF WORLD MOBILE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE ONE (1) MONTH PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.
THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY EVEN IF WORLD MOBILE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR NOT.
Disclaimer of Warranties
EXCEPT FOR ANY WRITTEN WARRANTY THAT MAY BE PROVIDED WITH A DEVICE YOU PURCHASED FROM WORLD MOBILE, AND TO THE EXTENT PERMITTED BY LAW, YOUR SERVICES AND DEVICES AND PROVIDED ON AN “AS IS” BASIS AND WORLD MOBILE MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ABOUT YOUR SERVICE, DEVICES, OR ANY APPLICATIONS YOU ACCESS THROUGH YOUR DEVICE. WORLD MOBILE DOES NOT WARRANT THAT YOUR DEVICE OR SERVICE WILL WORK PERFECTLY OR BE FREE FROM INTERRUPTIONS OR VIRUSES. WORLD MOBILE DOES NOT WARRANT THAT YOUR DEVICE WILL NOT NEED OCCASIONAL UPGRADES OR MODIFICATIONS, OR THAT IT WILL NOT BE NEGATIVELY AFFECTED BY NETWORK-RELATED MODIFICATIONS, UPGRADES OR SIMILAR ACTIVITIES. WORLD MOBILE DOES NOT WARRANT THAT YOUR COMMUNICATIONS WILL BE PRIVATE OR SECURE. IT IS ILLEGAL FOR UNAUTHORIZED PEOPLE TO INTERCEPT YOUR COMMUNICATIONS, BUT SUCH INTERCEPTIONS CAN OCCUR AND WORLD MOBILE HAS NO LIABILITY WHATSOEVER FOR ANY SUCH OCCURRENCE.

You agree to indemnify, defend, and hold harmless World Mobile, its affiliates, licensors, suppliers, agents, and employees (collectively, "Indemnified Parties") from and against any and all claims, actions, suits, proceedings, losses, liabilities, damages, costs, and expenses (including but not limited to reasonable attorneys’ fees and costs) arising out of or related to:
- Your use of the Services or any of your activities in connection with the Services;
- Your violation or breach of these Terms, any applicable law, or the rights of any third party;
- Your failure to comply with any applicable regulatory or legal obligations;
- Any content or data you submit, upload, or transmit through the Services, including any infringement of intellectual property rights or privacy rights of any third party;
- Your violation of the terms of any agreements with third-party service providers that World Mobile uses in providing the Services;
- Any other breach, act, or omission that causes harm or damage to World Mobile or its partners.
You shall promptly notify World Mobile of any claim or legal action for which you are required to indemnify World Mobile under this section. World Mobile reserves the right to assume the exclusive defence and control of any matter subject to indemnification at your expense. You agree to cooperate as fully as reasonably required in the defence of any claim.
This indemnification obligation will survive the termination or expiration of these Terms and your use of the Services.
[fs-toc-omit]15. Force Majeure
World Mobile shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to: acts of God, war, terrorism, strikes, riots, fire, flood, power outages, network disruptions, or any other event beyond its control.
In such cases, World Mobile will make reasonable efforts to notify you of the delay or non-performance and will resume performance as soon as reasonably possible.
[fs-toc-omit]16. Dispute Resolution and Arbitration
- Arbitration Agreement: Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will take place in New York, and the decision of the arbitrator will be final and enforceable in any court of competent jurisdiction.
- Waiver of Jury Trial: You and World Mobile agree to waive any right to a jury trial in connection with any legal dispute and agree to resolve disputes exclusively through arbitration.
[fs-toc-omit]17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the jurisdiction in which your billing address is located, without regard to its conflict of laws principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts of that jurisdiction.

World Mobile reserves the right to modify or amend these Terms at any time. Changes will be communicated to you via email or through a notification on our website. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
[fs-toc-omit]19. Termination
- Termination by You: You may terminate your subscription or User Account at any time by following the cancellation process set out in the Terms.
- Termination by World Mobile: World Mobile may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms, or if we deem it necessary for network maintenance or legal compliance.
- Termination of Home Field Advantage Offering: The Home Field Advantage Offering may be terminated as outlined in Section 22.

World Mobile may offer referral programs that reward customers for referring new users. Participation in these programs is subject to specific terms and conditions, and any rewards or bonuses are contingent upon successful referrals and account validation.
[fs-toc-omit]21. Miscellaneous
- Severability: If any provision of the Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire Agreement: The General Terms & Conditions, the Cellular Terms, and the Staking Terms, and the Home Field Advantage Offering Terms represent the entire agreement between you and World Mobile regarding the use of the Services, superseding any previous agreements or communications.
[fs-toc-omit]22. Home Field Advantage Offering Terms
- Overview: The Home Field Advantage Offering provides qualifying customers with a perpetual 30% discount on the Essential Plan and Advanced Plan subscriptions. This discount is available only to customers who meet specific geographic and device eligibility criteria.
- Eligibility Requirements:
- Customers must reside or work, or both, within the boundaries of World Mobile’s physical radio network for at least eighty percent (80%) of the time in any three-month period, as determined by World Mobile’s network data.
- Customers must utilize unlocked devices that support eSIM technology to access the Services.
- In the case of the Home Field Advantage Offering in Northern Nevada, the boundary currently includes, but may be changed at World Mobile’s sole discretion without notice, the cities and towns of Reno, Sparks, Carson City, Elko, Incline Village, Yerington, and Fernley, Nevada, and their nearby surroundings, as defined by World Mobile’s physical radio network coverage.
- Acknowledgment of Geographic Restrictions:
- By subscribing to the Home Field Advantage Offering, you acknowledge that the discount is only available while you reside or work within the boundaries of World Mobile’s physical radio network.
- If you move your place of residence or work outside of these boundaries, World Mobile will notify you via email, text message or through your User Account that your discount will be terminated. Termination of the discount will occur no earlier than 90 days after you lose geographic qualification, as determined by World Mobile’s network data.
- Availability and Termination:
- The Home Field Advantage Offering is not available in regions outside of World Mobile’s physical cellular radio network.
- World Mobile reserves the right to terminate the Home Field Advantage Offering at its sole discretion, provided that at least sixty (60) days of prior notification is given to subscribers via email, text message or through their User Account.
- Verification:
- World Mobile may require periodic verification of your geographic eligibility, which may include providing proof of residence or workplace location within the covered areas.
- Failure to meet the eligibility criteria or provide requested verification may result in the termination of the Home Field Advantage discount.
- Acknowledgment of Terms:
- By subscribing to the Home Field Advantage Offering, you acknowledge and agree to these terms, including the geographic and device requirements, the potential for discount termination due to relocation, and World Mobile’s right to terminate the offering with notice.

[fs-toc-omit]1. Risk Factors
1.1. The World Mobile Token Reward Program ("Program") offers WMTb tokens as rewards for eligible subscription purchases.
1.2. This Program is limited to the first 1,000 users and their transactions within the first month of the Program's launch.
[fs-toc-omit]2. Eligibility
2.1. Participation Requirements:
- Must be among the first 1,000 users to participate in the Program
- Must complete subscription payment during the Program period
- Must comply with all applicable laws and regulations
2.2. Eligible Transactions:
- Only subscription purchases made within the first month of Program launch
- Transactions must be successfully completed and paid in full

3.1. Reward Calculation:
- Monthly Subscriptions: 10% of subscription value in WMTb tokens
- 6-Month Subscriptions: 50% of subscription value in WMTb tokens
- Annual Subscriptions: 100% of subscription value in WMTb tokens
3.2. Token Value Determination
- WMTb token value is determined at the moment of purchase using the exchange rate of the WMTx token.
- Exchange rate is retrieved from CoinGecko's API
- Calculation based on subscription value before tax

4.1. Timing:
- Tokens are distributed after successful payment confirmation
- Recipients will be contacted by email on the address used to create a user account within 1 month after the subscription payment with instruction on how to claim the tokens
4.2. Verification:
- Users must have a compatible wallet to receive tokens
- World Mobile reserves the right to verify eligibility before distribution
[fs-toc-omit]5. Usage Restrictions
5.1. The attributed Tokens are limited for a duration of 2 years after the date of purchase. After the end of the 2 year vesting period, the WMTb token can be exchanged against the same amount of WMTx tokens. During the vesting period, only permitted actions can be performed with the tokens.
5.2. Permitted Actions:
- Premier staking initiatives
- Future Staking Contracts of World Mobile may be permitted at the discretion of World Mobile.
5.3. Only after term of the vesting period, WMTb tokens can be exchanged at a rate of 1 to 1 for non restricted WMTx tokens.

6.1. The Program:
- Begins on the official launch date
- Continues for one month or until 1,000 user limit is reached, whichever comes first
- All eligible transactions within this period will be honored

7.1. Program Limitations:
- Limited to first 1,000 participating users
- Only transactions within first month of launch
- Rewards based on pre-tax subscription value
7.2. Exclusions:
- Non-subscription purchases
- Failed or incomplete transactions
- Transactions after program expiration

- Comply with all applicable laws and regulations
- Maintain security of their wallet and private keys
- Report any suspicious activity immediately
8.2. World Mobile reserves the right to:

- Suspend or terminate participation in cases of suspected abuse

Please note that while these Terms govern the overall use of our services, specific services may be provided by different entities within the World Mobile Group, and by using such services, you agree to be bound by the terms applicable to the respective providing entity.
These Terms & Conditions (" Staking Terms") govern the use of mobile service plans provided by World Mobile Treasury Services Ltd ("World Mobile," "we," "us," or "our"). By signing to a Smart Contract, you agree to these Staking Terms and our General Terms & Conditions, Privacy Policy, and Acceptable Use Policy.

1.1. "Smart Contract" refers to the blockchain-based program that governs the staking protocol.
1.2. "Token" refers to the digital asset that can be staked within the Smart Contract.
1.3. "User" refers to any individual or entity that interacts with the Smart Contract.

4.1. Users acknowledge that blockchain technology and cryptocurrency investments carry inherent risks, including but not limited to:
- Smart Contract vulnerabilities

4.2. The protocol does not guarantee any returns or profits from staking.
4.3. Users are solely responsible for:
- Maintaining the security of their private keys
- Ensuring they have sufficient gas fees for transactions
- Understanding the technical aspects of blockchain interactions

- Not attempt to exploit or manipulate the Smart Contract

6.1. Users may withdraw their staked Tokens according to the Smart Contract's predefined parameters.
6.2. Withdrawal restrictions may apply, including:
- Minimum lockup periods
- Unbonding periods
- Withdrawal fees
6.3. Emergency withdrawals may be subject to penalties as specified in the Smart Contract.

7.1. Reward calculations and distribution methods are immutable and encoded in the Smart Contract.
7.2. Users are responsible for any network fees (gas fees) associated with their transactions.

8.1. The Smart Contract code is immutable once deployed.
8.2. These Terms and Conditions may be updated to reflect changes in legal requirements or operational practices.
8.3 The Smart Contract may be terminated by World Mobile at World Mobiles discretion.
8.4 If the Smart Contract is terminated by World Mobile, Users with active stakes can claim accrued rewards and unstake their tokens.

9.1. The Smart Contract operates on an "as-is" and "as-available" basis.
9.2. No party shall be liable for any indirect, incidental, special, or consequential damages.
9.3. Total liability is limited to the amount of Tokens staked by the User.

10.1. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
By using the Smart Contract, Users acknowledge that they have read, understood, and agreed to these Terms and Conditions.

1.1. "Program" refers to the World Mobile Premier Rewards Program.
1.2. "WMTx" refers to the World Mobile Token used for locking and rewards.
1.3. "WMTb" refers to the World Mobile Bonus Token used for locking.
1.4. "Tier" refers to one of the six membership levels in the Program.
1.5. "AirNode" refers to network nodes operated within the World Mobile ecosystem.
1.6. "Network Builder Hex" refers to a geographical area within the World Mobile network coverage.

When locking WMTb, the amount of WMTx required for reaching a tier is reduced by the amount of locked WMTb.

Users may use at any time 1 wallet for Premier Rewards and can be member of 1 membership tier
5.2. Reward Payment
Rewards are calculated in USD and paid in WMTx.
The amount of WMTx is determined at the moment when rewards are claimed. All claimable rewards in USD are added to the total amount in USD. The amount of WMTx is determined by the exchange rate at the moment of claim using the average of multiple exchange services
For inactive subscriptions after non-renewal or cancellation, the exchange rate for the rewards of the specific subscription is determined by the exchange rate at the last day the subscription was valid, using the average of multiple exchange services
Rewards must be claimed by the user using the same wallet for authentication as has been used for entering the premier rewards program.
5.3. Unlocking Process
Users may unlock at any time
Accrued rewards must be claimed before unlocking

PLEASE READ THESE USER TERMS AND CONDITIONS OF USE CAREFULLY BEFORE REGISTERING ON, AND USING, OUR MOBILE APP AND EACH OF THE SERVICES.
These User Terms apply to your use of our services via our App available to download from the Apple App Store (in due course) or Google Play.
You should only use the App and the Services (as applicable) if you agree with these User Terms. When you click to accept the User Terms, you will be legally bound by these User Terms. We recommend that you print a copy of these User Terms for your records or alternatively you may ask us for a copy of these User Terms at any time.
We may change these User Terms from time to time. If we do, you must read the updated User Terms the next time that you log into your account. If you agree to the updated User Terms, you will need to click to accept them before you are able to access your account. If you do not agree to the updated User Terms, you will not be able to access your account.

We World Mobile Service Limited of Floor 4, Banco Popular Building, Road Town, Totola, VG1110, B.V.I. (WM, We or Us) license you to use:
World Mobile mobile application software, the data supplied with the software, (App) and any updates or supplements to it.
The service you connect to via the App and the services we provide to you through it set out below (Services).

Under data protection legislation, we are required to provide you with certain information including who we are, how we process your personal data and for what purposes and your rights in relation to your personal data and how to exercise them. This information is provided in World Mobile | Privacy Policy. and it is important that you read that information.
Where you exercise your right to delete your account and request that all personal data we hold you on you is erased (by following the procedure set out in the App), the way we carry out this request will be dependant on the type of account you have created.
If you have created an account within the App – a “Custody Account” – all account details and personal data within that Custody Account will be deleted upon request. This data will not be recoverable.
However, if separately you have created your own self-sovereign account (“SSA”) outside of the App, then the only data we would be able to remove from your account will be KYC related data we hold, you and the applicable third party provider are ultimately responsible for the data held within your SSA.
The relevant App Store's User Terms also apply.
The ways in which you can use the App may also be controlled by the Google Play's rules and policies Google Play Terms of Service and Google Play's rules and policies will apply instead of these User Terms where there are differences between the two.

This app requires an Android device with a minimum of 45MB of memory and the Android operating system 6.0 and above.

How you may use the App, including how many devices you may use it on
In return for your agreeing to comply with these User Terms you may:
Download or stream a copy of the App onto an Android Device (6.0 or higher) and view, use and display the App and the Service on such devices for your personal purposes only; and
Receive and use any free supplementary software code or update of the App incorporating "patches" and corrections of errors as we may provide to you.

From time to time we may automatically update the App and change the Service to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the App for these reasons.
If you choose not to install such updates or if you opt out of automatic updates, you may not be able to continue using the App and the Services.

If you download or stream the App onto any phone or other device not owned by you, you must have the owner's permission to do so. You will be responsible for complying with these User Terms, whether you own the phone or other device.

The App or any Service may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any).

If you agree to and comply with these User Terms, we grant you a non-exclusive, non-sublicensable and non-transferable license to use the App and each of the Services for your personal use or internal business use only. Except as otherwise expressly permitted in these User Terms, you will not: (a) reproduce, modify, adapt or create derivative works of any part of the App or the Services; (b) rent, lease, distribute, sell, sublicense, transfer, or provide access to the App or the Services; (c) use the App or the Services for the benefit of any third party; (d) incorporate the App or the Services into a product or service you provide to a third party without our prior written consent; (d) circumvent mechanisms in App intended to limit your use; (f) reverse engineer, disassemble, decompile, translate, or otherwise seek to obtain or derive the source code, including images and texts, underlying ideas, algorithms, file formats or non-public APIs to the App, except to the extent expressly permitted by applicable law (and then only upon advance notice to us); (g) remove or obscure any proprietary or other notices contained in the App (h) use the App for competitive analysis, as part of any other software or project of any kind or to build competitive products.

You must:
Not use the App or any Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these User Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the App, any Service or any operating system;
Not infringe our intellectual property rights or those of any third party in relation to your use of the App or any Service (to the extent that such use is not licensed by these User Terms);
Not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App or any Service;
Not use the App or any Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
Not collect or harvest any information or data from any Service or our systems or attempt to decipher any transmissions to or from the servers running any Service.

All intellectual property rights in the App, and the Services throughout the world belong to us (or our licensors) and the rights in the App and the Services are licensed (not sold) to you. You have no intellectual property rights in, or to, the App, or the Services other than the right to use them in accordance with these User Terms.

You acknowledge that the App or the Services may use, incorporate or link to certain open-source components and that your use of the App or Services is subject to, and you will comply with any, applicable open-source licenses that govern any such open-source components (collectively, “Open-Source Licenses”). The use of the App and the Services are governed by those Open-Source Licenses, or the licence provided by WM pursuant to these User Terms (the “WM Licence”), as applicable. Unless otherwise permitted pursuant to the Open-Source Licenses, you may not: (a) resell, lease, lend, share, distribute or otherwise permit any third party to use the Platform or the Services; or (b) use the Platform or the Services for time-sharing or service bureau purposes. You may not otherwise use the App or the Services in a manner that violates the WM License or any Open-Source Licenses.
[fs-toc-omit] We may end your rights to use the App and the Services if you break these User Terms
We may end your rights to use the App and Services at any time by contacting you if you have broken these User Terms in a serious way. If what you have done can be put right we will give you a reasonable opportunity to do so.
If we end your rights to use the App and Services:
You must stop all activities authorised by these User Terms, including your use of the App and any Services.
You must delete or remove the App from all devices in your possession and immediately destroy all copies of the App which you have and confirm to us that you have done this.
We may remotely access your devices and remove the App from them and cease providing you with access to the Services.

We may transfer our rights and obligations under these User Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
You need our consent to transfer your rights to someone else
You may only transfer your rights or your obligations under these User Terms to another person if we agree in writing.

This agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
If a court finds part of this contract illegal, the rest will continue in force
Each of the paragraphs of these User Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Even if we delay in enforcing this contract, we can still enforce it later
Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these User Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
Which laws apply to this contract and where you may bring legal proceedings
These User Terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.

In no event shall a description or reference to a third party’s product or service (including, but not limited to, providing a description or reference via hyperlink) be construed as an endorsement or promotion of such third-party products or services by us. We retain the exclusive right to add to, modify, or cancel the availability of any Third-Party Service. You may agree to receive push notifications from Third Party Content providers. In order to receive push notifications, you must opt into the service. Push notifications will not be automatically enabled on your device for Third Party Content. We do not control, endorse, or adopt any Third-Party Content shared through push notifications, and will have no responsibility for Third Party Content including, but not limited to, token availability and/or sales. If, to the extent permitted by the App, you grant express permission to a third party to access or connect to your WM account, either through the third party’s product or service or through the App, you acknowledge that granting permission to a third party to take specific actions on your behalf does not relieve you of any of your responsibilities under these User Terms. You are fully responsible for all acts or omissions of any third party with access to your wallet.

The App may contain copyrighted material and trademarks including, but not limited to, text and graphics (the “Content”), which is protected by copyright law, registered and unregistered trademarks, and other intellectual property rights. Unless otherwise provided, we exclusively own the Content. Your use of App does not grant you any right, title, or interest in the Content. You agree that you will not copy, reproduce, modify, republish, upload, post, transmit, distribute, collect, sell, license, create derivative works from, or, in any other way, whether manual or automated, exploit any of the Content, in whole or in part.

Please note that all transactions involving Digital Assets involve certain risks. In this regard, once submitted to a blockchain network, such a transaction will be unconfirmed for a period of time pending sufficient confirmation of the transaction by the blockchain network. A transaction is not complete while it is in a pending state. Any Digital Assets transfers, to and from external wallet addresses, that are in a pending state will be designated accordingly, and the relevant Digital Asset will not be included in your Digital Asset Wallet or be available to conduct transactions.
In any transfer of Digital Assets, there is always a risk that the Digital Assets can be lost due to the collapse of the community that supports Digital Asset transfers, or the failure or bankruptcy of the issuers and/or managers of that Digital Asset. In such scenarios, your Digital Assets could lose significant value and/or be lost all together if they are in a pending state of transfer.
The risk of loss in holding Digital Assets can be substantial. You should therefore carefully consider whether holding Digital Assets is suitable for you in light of your financial situation. In considering whether to hold Digital Assets, you should be aware that the price or value of Digital Assets can change rapidly, decrease, and potentially even fall to zero. Past performance is not an indicator of future performance. If you use any App Services which allow you and/or third parties to access and hold Digital Asset private keys, you acknowledge that we are not responsible for safeguarding such keys and that we are not responsible for any loss of Digital Assets resulting from theft, loss, or mishandling of Digital Asset private keys outside our control.
We are not responsible for the market of Digital Assets, and we make no representations or warranties concerning the real or perceived value of Digital Assets as denominated in any quoted currency. Although we may provide historical and/or real-time data regarding the price of Digital Assets, including graphs displayed within the App showing the price fluctuations of Digital Assets, such data or graphs are for reference only. We make no representations regarding the quality, suitability, veracity, usefulness, accuracy, or completeness of such data or graphs, and you should not rely on such data or graphs for any reason whatsoever. You understand and acknowledge that the value of Digital Assets can be volatile, and you agree that we are not in any way responsible or liable for any losses you may incur by holding or trading Digital Assets, even if the App Services were delayed, suspended, or interrupted for any reason.
We do not provide investment advice tax advice, financial advice or any other professional advice and any content on the App should not be considered as such advice or a substitute for tailored investment, financial advice. The contents of the App does not constitute a comprehensive or complete statement of the matters discussed or the law relating thereto. The contents of the App should not be used as a basis for making investment decisions and should not be construed as an attempt to market or promote any type of Digital Asset.

You agree that you will not violate any laws when using our Services. This includes any local, provincial, state, federal, national, or international laws that may apply to you. You agree that you will not use our Services to pay for, support, or otherwise engage in any illegal activities including, but not limited to, illegal or otherwise prohibited trade, illegal gambling, fraud, money laundering, or terrorist activities. For the avoidance of doubt, if we discover that you have violated these User Terms and/or any applicable laws or regulatory requirements, including, but not limited to, the Bank Secrecy Act, we reserve all of our rights and remedies under these User Terms and at law and will take all necessary actions against you. You further agree that: (i) you will not encourage or induce any third party to engage in any of the activities prohibited under this Section; (ii) you will not impersonate someone or use or attempt to use another user’s wallet without authorization or use our Services in any manner that could interfere, disrupt, negatively affect, or inhibit other users from fully enjoying it; (iii) you will not distribute any virus or other harmful computer code through the App; (iv) you will not take any action that may impose an unreasonable or disproportionately large load on our or any of our third party providers’ infrastructure; (v) you will not reverse engineer or bypass, circumvent, or attempt to bypass or circumvent any measures that we may use to prevent or restrict access to the Services including, without limitation, other accounts, computer systems, or networks connected to the Services; and (vi) you will not violate, misappropriate or infringe the rights of WM, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights. Although we have no obligation to monitor any user content, we have absolute discretion to take any necessary actions any time and for any reason without notice in the event you breach these User Terms. Any use of the App or the Services other than as specifically authorized in these User Terms, without our prior written permission, is strictly prohibited and we shall have the right to terminate your license to use the App or the Services immediately without notice. You acknowledge and accept that by using the Services, you may be exposed to content that is offensive, indecent, or objectionable. We take no responsibility and assume no liability for any user content, including any loss or damage to any of your user content.

You acknowledge and agree that we have no control over, and no duty to take any action regarding: (i) failures, disruptions, errors, or delays in the processing of Digital Assets that you may experience while using the Services; (ii) the risk of failure of hardware, software, and Internet connections; (iii) the risk of malicious software being introduced or found in the software underlying the App and the Services; (iv) the risk that third parties may obtain unauthorized access to information stored within the App, including, but not limited to your wallet address, private key, and secret phrase; and (v) the risk of unknown vulnerabilities in or unanticipated changes to the applicable blockchain networks. You release us from all liability related to any losses, damages, or claims arising from: (a) user error such as forgotten passwords, incorrectly constructed transactions, or mistyped Digital Asset addresses; (b) server failure or data loss; (c) unauthorized access to the App and the Services; (d) bugs or other errors in the App and the Services; and (e) any unauthorized third party activities, including, but not limited to, the use of viruses, phishing, brute forcing, or other means of attack against the App and the Services, and the provision of any fiat services by our Fiat Partner(s). We make no representations concerning any third-party Content contained in or accessed through our Services. Any other User Terms, conditions, warranties, or representations associated with such content, are solely between you and such organizations and/or individuals.

APPENDIX 1
The WM Wallet
[fs-toc-omit] ELIGIBILITY
To be eligible to use the WM Wallet: (i) you must not be a resident of sanctioned jurisdictions according to any trade embargoes, UN Security Council Resolutions (“UNSCR”) or HM Treasury's financial sanctions regime; and (ii) you must not be currently the subject of or subject to economic sanctions such as the United Nations Security Council Sanctions List, the list of specially designated nationals maintained by OFAC, the denied persons or entity list of the U.S. Department of Commerce or any similar list maintained by any other relevant sanctions authority. You can only use our Services if permitted under the laws of your jurisdiction. For the avoidance of doubt, you may not use our Services if you are located in, or a citizen or resident of any state, country, territory or other jurisdiction where your use of our Services would be illegal or otherwise violate any applicable laws. Please make sure that these User Terms are in compliance with all laws, rules, and regulations that apply to you. You agree that you are only using our Services with legally-obtained funds that rightfully belong to you. By using the WM Wallet, you represent and warrant that you meet all eligibility requirements that we outline in these User Terms. We may still refuse to let certain people access or use the WM Wallet, however, and we reserve the right to change our eligibility criteria at any time.

The WM Wallet is a non-custodial wallet software (the “WM Wallet”), for certain cryptocurrencies (“Digital Assets”), meaning you are solely in control of and responsible for your Digital Assets and private keys, and accordingly you can authorize transactions from your wallet address. You expressly acknowledge and agree that as the WM Wallet is a non-custodial wallet software, you are solely responsible for your activity and any risk of loss at all times.
[fs-toc-omit] Wallet Address, Private Key, and Backup Capabilities
An encrypted backup of certain information associated with your wallet can be stored on eligible devices. The private key is associated with the wallet address and, together, they can be used to authorize the transfer of Digital Assets to and from that wallet address. It is very important that you backup your private keys, backup phrases or passwords. Failure to do so may result in the loss of control of Digital Assets associated with your wallet. You acknowledge and agree that we do not receive or store your wallet password, encrypted private key, unencrypted private key, or secret phrase associated with your wallet. We cannot generate a new password for your wallet if you fail to remember your original password. If you have not safely stored a backup of any wallet address and private key pairs maintained in your wallet, you accept and acknowledge that any Digital Assets you have associated with such wallet address will become inaccessible. On that basis, we shall have no responsibility or liability whatsoever in the event you are unable to access your wallet for any reason including without limitation your failure to keep your wallet address, secret phrase and private key information secure.

In order for all proposed Digital Asset transactions to be completed, they must be confirmed and recorded in the Digital Asset’s associated public blockchain. Such networks are decentralized, peer-to-peer networks supported by independent third parties, which we do not own, control, or operate. We have no control over the blockchain networks and, therefore, cannot and do not ensure that any transaction details that you submit via our Services will be confirmed and processed. By using the WM Wallet, you acknowledge and agree that: (i) we do not have the ability to cancel or otherwise modify your transaction; (ii) the transaction details you submit may not be completed, or may be substantially delayed, by the applicable blockchain networks; (iii) we do not store, send, or receive Digital Assets; and (iv) any transfer that occurs in relation to any Digital Asset occurs on the relevant blockchain network and not on a network owned by us and therefore we do not guarantee the transfer of title or right in any Digital Asset. We have no control over the blockchain networks and, therefore, cannot and do not ensure that any transaction details that you submit via our Services will be confirmed and processed.

You represent and warrant that any information you provide via the Services is accurate and complete. You accept and acknowledge that we are not responsible for any errors or omissions that you make in connection with any Digital Asset transaction initiated via the Services. We strongly encourage you to review your transaction details carefully before attempting to transfer a Digital Asset.
[fs-toc-omit] WALLET REGISTRATION AND SECURITY
You must either import or create a wallet in order to use the WM Wallet. When you create a wallet, you will be assigned a private key. You agree to immediately notify us of any unauthorized use of your private key or any other breach of security of your wallet. Notwithstanding the foregoing, you acknowledge and agree that you shall assume all risks related to the use of the Services and you shall be solely responsible for maintaining the confidentiality and security of your private key. When you create a wallet, you are strongly advised to take precautions in order to avoid loss of access to and/or control over your wallet. Suggested measures include, but are not limited to, the following: (a) creating a strong unique password that you do not use for any other purpose (i.e. different to your phone password or any other passwords you use for websites, online services, etc.) and leveraging biometric authentication if available; (b) do not store the private key and secret phrase in plain text online or in an unsecured physical location; (c) limiting access to your devices and your wallet; (d) taking all necessary precautions against malware on your devices and networks; and (e) promptly notifying us if you discover or otherwise suspect any security breaches related to your wallet. Notwithstanding anything to the contrary herein, we shall have no liability whatsoever in connection with activities that occur on your wallet with or without your authorization.

Fees applicable to the Services or any component of the Services, if any, shall be set out clearly in the App.
[fs-toc-omit] Transaction Fees
There may be transaction fees (e.g. mining fees) associated with your virtual currency transactions that are required by the virtual currency system or blockchain network that you engage with. You must ensure that you have an adequate balance in your wallet and/or “gas” to complete transactions before initiating a transaction. You acknowledge and agree that we will not be liable for any failed transactions or losses you incur due to incorrectly set transaction fees (i.e. too low or too high) or due to insufficient funds or gas associated with your wallet address. You further acknowledge and agree that we do not have access to your or anyone else’s transactions.

[fs-toc-omit] Network Credits and the Marketplace
The App also offers an electronic commerce platform specialized in the resale of closed-loop gift cards, vouchers and other products (“Product” or “Products”), of fixed or variable amounts, in different currencies, that can be redeemed by you at WM’s store or the issuer’s store (as applicable), in exchange for services and products offered by such issuer.
WM offers different Products depending on your country. WM allows you to select you country and displays all the offers available in that country. WM does not guarantee that a Product purchased from one country page will work when used in a different country and therefore strongly advises you to read the User Terms and conditions of each particular Product.
Some Products sold are geographically limited to certain countries. In these cases, if you are attempting to purchase from a country that is not allowed by a Product’s User Terms and conditions, such a purchase will not be possible.
Upon selection and payment, you will receive access to the Product either on screen or by email to their email account.
WM will endeavour to keep expected timescales transparent but shall not be held responsible for delays and losses caused by you or third parties.
In case your Product does not arrive within 30 minutes of successful payment, please contact us at support@worldmobile.io.
Your use of the Products is continuously monitored to ensure the safety and regulatory compliance of WM’s platform. Suspicious transactions will be reported to competent authorities.

The Products can be purchased via our third-party payment provider in either fiat or cryptocurrency, or mobile money or via your credits balance (“Balance”).

You may choose to pay directly with one of the cryptocurrencies accepted at the time of purchase by WM or by using a third-party crypto payment service that is available at check-out. These payments may be subject to fees and confirmation time, as stated in the User Terms and conditions of such third-party providers.

If the option is available from time to time, Customers may also choose to pay using their Mastercard or Visa payment card. Such payments are processed by a third-party provider, identified on the payment page, whose User Terms and conditions apply. WM does not have access to your payment details, which are inserted by you directly into the secure payment gateway of the third-party provider.
Should you have any complaints about your payment with fiat, we kindly ask you to direct your queries to the third-party provider used for the payment or to your bank directly.

[fs-toc-omit] Purchase of Digital Assets
The App allows users to buy and sell Digital Assets including non-fungible tokens and other tokens and coins that are carefully selected by WM (the “Fiat Services”).
In providing these Fiat Services, WM may partner with a third-party service provider to facilitate the provisions of any Fiat Services (a “Fiat Partner”) and, if applicable, you will open an account with such Fiat Partners by completing the relevant registration and identity verification for such account, and by accepting any user agreements, terms and conditions, policies and procedures or similar documents of any Fiat Partners.
Any payments expressed in any fiat currencies, and which have been made in connection with any Fiat Services may not be cancelled, recalled or refunded, and that any chargeback requests in connection with any Fiat Services that involve a Fiat Partner, are subject to that Fiat Partner's policies and procedures.
You acknowledge and agree that: (i) we are not responsible for your use of the service provided by a Fiat Partner and shall have no liability whatsoever in connection with your use of such service; (ii) you will be subject to any User Terms and conditions imposed by the relevant third party service provider; (iii) we have no ability to change, withdraw or cancel any conversion requests you place; (iv) we are not responsible for any exchange rates offered by the relevant third party service provider(s); and (v) we are not responsible for any fees charged by the relevant third party service provider(s) or your bank or credit card issuer(s).
Further, by using the App and any Fiat Services, you acknowledge and agree that WM is not responsible for examining or evaluating the content, accuracy, completeness, availability, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of a Fiat Partner’s services, content or websites. We do not warrant or endorse and do not assume and will not have any liability or responsibility to you or any other person for any such third-party services, or third-party websites, or for any other materials, products, or services of Fiat Partners. Services offered by our Fiat Partner via the App and links to other websites are provided solely as a convenience to you.

[fs-toc-omit] Scanning the network in return for credits
You may utilise the feature in the App to actively scan your surrounding environment for network coverage (“Scanning for Coverage”) and share the data collated with us so that we can work to improve connectivity for all. This may include:
Scanning for Coverage will require the geolocation of the User. In all cases, access to the Scanning for Coverage service will require such geolocation is subject to the prior express acceptance of the User to be geolocated.
To do this, the User must, if they wish to do so:
· In the App, allow the App to use the geolocation feature. This authorisation may, at any time, and without charge, be revoked or granted from the terminal system settings.
· The deactivation of geolocation by the App and/or of the geolocation feature of the mobile terminal blocks the related Services, namely: the positioning of the tests on the maps, the active mapping.
When Users commence Scanning for Coverage, WM will award, at our discretion points which may be converted to credits on the App.
[fs-toc-omit] Misuse of the App
1. Prohibited Actions: Users are strictly prohibited from engaging in any form of misuse of the app, including but not limited to:
· Providing false or misleading information.
· Utilizing fake or spoofed locations.
· Any other actions that violate the intended use of the app.
2. Consequences of Misuse: In the event that a user is found to have engaged in any of the prohibited actions mentioned above, the app reserves the right to take appropriate actions, which may include:
· Removal or deduction of points.
· Temporary suspension of the user's account.
· Permanent ban from using the app.
3. Discretionary Power: The determination of what constitutes misuse and the appropriate response thereto shall be at the sole discretion of the app's administrators.
4. No Refunds: Any points or rewards forfeited as a result of misuse will not be reinstated or refunded.
By using this app, you agree to abide by these terms and acknowledge that violations may result in penalties as outlined above.
